A jury has found Sen. Kevin Parker guilty of two misdemeanor counts of criminal mischief and he faces up to one year in jail on each count (although a single year is more realistic, I’m told), Josh Robin of NY1 reports.

That means the Brooklyn Democrat will not automatically lose his seat, which would have occurred had he been found guilty of a felony.

However, as you’ll recall, former Sen. Hiram Monserrate’s colleagues set a precedent when they expelled him in the wake of his conviction on a misdemeaor charge of assaulting his girlfriend.

So, it will be interesting to see how senators rationalize not seeking to oust Parker from the chamber (assuming they don’t).

Parker was accused of beating up a NY Post photographer who approached the senator’s Flatbush home to take photos to accompany a story about his mortgage problems. Parker ripped the door off the photographer’s car and broke his finger.

The senator also has a history of anrgy outbusts, and underwent court-ordered anger management counseling after punching a traffic ticket agent in 2005.

Following his arrest in the spring of 2009, Parker was stripped by Senate Democratic leaders (at the time, Senate President Malcolm Smith still held the majority leader title) of his posts as majority whip and Energy Committee chairman, which carried a $22,000 stipend.

But, as it turns out, Parker had already pocketed his lulu.
